1. Object of the Contract
Object of the Contract Agreement is the definition of the services selected from the list that Miraffe Travel Agency offers, that is the middleman between customer and providers in Uganda. Depending on the customer’s interest, the Miraffe Travel Agency arranges safari, tours and community visits in Uganda, flight tickets and accommodation regarding customer choice or tailored program for the customer.
Furthermore, the Cuntract defines the start and the end dates of the selected program. The prices listed on the miraffe.com website are approximate, the exact calculation is prepared according to the length of stay and the choice of activities after agreement with the candidate. Price, date, length of the stay and range of services are binding after confirming the reservation.
Miraffe Travel Agency is not responsible for damages to customers in the form of canceled or delayed stay due to force majeure (nature disasters, war, strikes, flight cancellation due to bad weather etc.), intervention of the authorities, breakdown or problems with the means of transport or the political situation in the country etc. Miraffe Travel Agency only mediates the services of other operators for whose mediation it undertakes.
2. Contract Formation
The contractual relationship between the customer and the Miraffe Travel Agency is established at the moment of signing the Contract and payment of the relevant advance by the customer, ie. sending the amount to the account of the agency.
The payment can be done in cash or by the bank transfer in CYK, EUR or USD. Without deposit payment the Contract is considered as a reservation with a maximum validity of 10 days. The Contract shall be signed in two copies, one for each party.
3. Payment Terms
The price of the trip is contractually agreed between the customer and Miraffe Travel Agency and is considered as a deposit until the trip realization. Prices do include VAT. The price includes only services agreed with the customer and specified in the Contract.
Unless agreed otherwise, the price does not include other additional expenses such as Insurance.
Within 14 days of the booking confirmation (unless otherwise agreed in writing) clients are required to pay 40% of the total price of the stay (unless agreed otherwise).
By accepting the amount to the Miraffe Travel Agency account, their binding booking is completed. Failure to pay the deposit within 14 days is considered as cancellation of the order by the customer. The remaining balance must be paid at the latest 40 days before the departure of the trip. The amount can be paid all at once. Non-payment is considered as cancellation of the order by the customer and will be proceded by the cancellation rules written below.
The order made in less than 40 days before departure, the full amount must be paid.
Prices listed on the Miraffe website is only an orientation range. The final price of the stay or trip depends on the number of passangers, length of stay, program activities and choice of the accommodation.
The price is final after confirmation of the binding reservation. After receiving the advance payment, the customer agrees and accepts the cancellation policy.
Miraffe can only change this price if there is a major change in the exchange rate to € or NOK (+ 10%) or an increase in the price of the accommodation and program providers. The customer will be immediately informed at least 21 days before starting date of the stay. The customer is obliged to pay the difference in price within 5 calendar days from the news delivery . In case of non-compliance, Miraffe Travel Agency follows the cancellation policy. With a price increase of more than 10%, Miraffe Travel Agency undertakes to refund all fees paid by the customer only upon written request from the customer in the shortest possible time.
5. The rights and obligations of the customer and Miraffe Travel Agency
The Customer undertakes to provide Miraffe Travel Agency with all necessary documents and information necessary to ensure all services ordered. Also to pay the agreed price set in the Agreement under the terms set forth above, and to prove payment upon request.
The customer further undertakes to take over all documents for his / her stay and check them properly, arrive in time at the meeting point specified in the detailed instructions, adhere to the passport, customs and health regulations of the visited country, carry all required valid documents necessary obligations that are set by international health regulations. All costs incurred for failure to comply with this paragraph shall be borne by the Customer. Later claims will not be considered.
If there are any deviations from the agreed services, the customer is obliged to inform the Miraffe Travel Agency without delay and provide the necessary cooperation to remove them. The customer is obliged to pay the damages which he /she caused in full extent. The Customer has the right to properly provide services and information about any changes in the scope of services.
If the customer wants to change the accommodation, term or number of persons without giving reasons, this must be done no later than 30 days before arrival. If this is later and it is not possible for Miraffe to make these changes, they will not be considered and will be dealt with according to the cancellation conditions. The first change of reservation is free of charge, another 500, -CZK or no discount. If the change is not possible, the Miraffe Travel Agency proceeds according to the cancellation conditions. In case of cancellation of the reservation due to force majeure (natural disaster, political and security situation in the country, etc.) and upon presentation of a written confirmation, the Miraffe travel agency will not require any cancellation fee. The client is obliged to inform all participants booked stay with the general conditions of participation at the Miraffe travel agency and the quality of the accommodation and service booked.
If the services in the offer do not correspond to reality, the customer has the right to make a complaint to service provider (accommodation or program) and work with Miraffe Travel Agency to get rid of the causes or objections immediately. 14 days after the end of the stay at the latest.
The customer must deliver a written objection or complaint to a Miraffe Travel Agent. Later claims will not be considered. The Agency undertakes to reply to the customer in writing within one month of receiving the objection to the result of the investigation. It will only handle complaints whose cause could not be rectified at the place of accommodation or program. The Miraffe Travel Agency does not guarantee any possible changes to the ordered services, that may occur through foreign influence. Miraffe reserves the right to change the reservation in the event of extraordinary circumstances that cannot be avoided or changed (see point 1). Reserved accommodation may change only after agreement with customer. If this is 15% more expensive, it reserves the right to charge this difference only after agreement with the client. In case of disagreement, the full amount will be refunded. It undertakes to provide as much information as possible about the traffic, security situation in the country, accommodation and program at the places offered.
The Miraffe Travel Agency is obliged to duly and truthfully inform about all facts concerning the agreed services. Miraffe Travel Agency is not obliged to provide the Customer with services that have not been duly arranged or paid.
No insurance is included in the price. We recommend clients to take out the usual travel insurance and insurance against damage or loss.
7. Cancellation conditions
The customer has the right to back out from the contract by personal notice, registered letter or email. In such a case, he/she is obliged to pay cancellation fees of Miraffe to the amount of:
– 2000, – CZK of the total price if the contract is canceled more than 90 days before the accommodation.
– 25% of the total price upon cancellation of the contract 90 – 40 days before arrival.
– 50% of the total price for cancellation between the 39th and the 15th day prior to commencement.
– 100% of the total price if the contract is canceled less than 14 days prior to commencement or fails to arrive.
As the written notice of cancellation is considered the date of received cancellation! Upon cancellation, the customer will be refunded the amount paid so far minus the cancellation fee. In cases whenTit is necessary to pay services in advance, the cancellation conditions may be adjusted. The customer will be notified in writing of the current cancellation fee.
If a customer cancels their participation for serious reasons and immediately informs the Miraffe Travel Agency, the agency can reduce the cancellation fee up to 10% unless this does not cause rise to outstanding obligations to other service providers – in particular airlines.
8. Vaccination and health recommendations
Vaccination and health prevention information provided by the agency, which the customer should undergo before traveling abroad, is not binding, but advisory, except for mandatory vaccinations to the destination, which the country requires as a condition for admission to its territory. The use of medication and vaccination of any kind should be consulted with a specialist. The customer is responsible for the medical preparedness of the stay. The customer is obliged to respect the health regulations of the visited country and to receive the vaccinations, which are listed as mandatory.
The validity of the vaccination will be documented by the customer upon entering the country by having a valid International Vaccination Card, where the vaccination is stated. Due to the climatic conditions of the country, we recommend that the customer has protective equipment with him.
9. Visa requirements and passport
The customer undertakes to hold a valid passport for the duration of the stay, especially for the period of validity of min. 6 months after returning from abroad. Furthermore, it undertakes to observe, in particular, customs passport, health and other legal regulations of the state. Miraffe Travel Agency is not responsible for the consequences of non-compliance.
The visa is handled separately by the customer or can be used by the Miraffe Travel Agency for a fee. If the customer wishes to use this service, he / she is obliged to provide his / her passport with a sufficient number of free pages and required validity, a duly completed visa application, sufficient photographs and other documents required by the embassy. Miraffe Travel Agency is not liable for any non-granting of visas and consequent damages for non-attendance. The costs incurred as of the date of cancellation due to the non-issue of the visa shall be borne by the customer, as well as the costs incurred due to the non-stay due to insufficient passport validity period.
10. Customer’s consent to the processing of personal data
The customer agrees to the use of his / her personal data stated in the contract and in all documents related to the stay as well as the use of of these data for the needs of the travel agency Miraffe and its business partners in accordance with Act No. 101/2000 Coll., on the protection of personal data. He further declares that he is also authorized to grant this consent on behalf of all persons whose personal data he has communicated to Miraffe.
The Customer declares that the personal information provided by him / her regarding himself / herself and other participants is correct, complete and true. Should this claim prove to be false, the customer is exposed to the risk of obligation damages caused to the Miraffe Travel Agency by providing incorrect data, respectively, criminal sanction. The contractual relationship established by this contract is governed by the laws of the Czech Republic, in particular the Act no. 89/2012 Coll., Civil Code, as amended and Act no. 159/1999 Coll., On Certain Conditions of Business Activities in the Field of Tourism.
11. The Customer declares that:
He / she is not aware of any serious illnesses that would endanger his / her health or safety during the stay he / she is applying for.
If he / she concludes the Contract for the benefit of a person under the age of 18, he / she is the legal representative furthermore, the consent of other legal representatives to agree to her participation in the stay.
It agrees to the provision and processing of its personal data necessary for the registration of the travel agent Miraffe in accordance with Act No. 101/2000 Coll. .
By signing the reservation or paying the deposit, the customer confirms that he / she agrees to the stated conditions.
